MPI Carolinas Chapter COVID-19 Assumption of Risk and Release from Liability (“Agreement”)

The MPI Carolinas Chapter (“MPI-CC”) is concerned for the health and well-being of its community. The nature of the COVID-19 disease is such that actions taken by you affect not only your well-being, but also those of every other person you interact with or every person who uses the same spaces you use. MPI-CC has collaborated with event facilities to develop safety protocols and safety measures designed to minimize the risk of COVID-19 infections. MPI-CC will continually review and, as appropriate, update these protocols to incorporate the latest guidelines and information. Despite MPI-CC’s efforts to minimize these risks, it is impossible to eliminate the possibility that you could be exposed to or contract COVID-19 while participating in MPI-CC events. A signed Agreement is required prior to your participation in MPI-CC In-Person Events.

I, Name as Listed on MPI-CC Registration for the 2023 Annual Meeting, wish to participate in a MPI-CC In-Person Event. In consideration of the services to be rendered in providing the Event and in consideration of my participation in and receipt thereof, I hereby agree to the following: 

1. I understand that during the MPI-CC In-Person Event, I may come into close contact with other participants. I understand that there is a potential I could be exposed to and contract COVID-19.

2. I understand that any hotel employees, hotel guest, or any other vendor of which I take part or participate during the Events, the other participants of the Event (whether associated with my group or not), and other third parties (collectively, “Third Parties”), are not the agents or employees of MPI-CC and that dangers, including those related to COVID-19, may be caused by the negligent or intentional act(s) or omissions of such Third Parties. I understand that MPI-CC is not responsible for any injuries or property damage that may be caused by the acts or omissions of such Third Parties.

3. I understand that my participation in this MPI-CC In-Person Event is entirely voluntary and at my own risk. I fully understand the scope of the Events and the potential risks, including those related to COVID-19, involved in the Events. I agree to assume the risks of my participation in the Events, including the risk of exposure to and infection of communicable diseases.

4. I agree to follow guidelines and recommendations given to me by hotel staff and the MPI-CC Management Office prior to, and during the MPI-CC In-Person Event.

Guidelines are as follows:

• We ask that you practice proper sanitation measures, by using our widely provided hand sanitizers, and wiping down frequently touched surfaces in your seating area.  
• We ask that you assess your personal health prior to arrival, which will include confirmation of body temperature at or below 100.3F, no new cough, no shortness of breath or difficulty breathing, no loss of taste or smell, no chills, and no sore throat.
• Lastly, prior to arrival confirm that you have not had close contact in the last 10 days with someone diagnosed with COVID-19, or been advised to isolate or quarantine at the time of the MPI-CC In-Person Event.

I understand that any violations of these policies, and regulations may result in removal from Events.

5. I hereby release and fully discharge MPI-CC, including its Board of Directors, and Management Office, from any and all claims or causes of action that may be brought by me or by any other person, including all liability for damage to personal property, personal injury or loss arising out of or related to my participation in the Event to the fullest extent permitted by law.

6. This Agreement shall be governed by and construed under the laws of North Carolina. Notwithstanding any other agreement that I have signed related to the Events that purports to establish the venue for any litigation arising from the MPI-CC In-Person Event, I agree that I will file no action against MPI-CC or its officers, contractors, and agents, whether based on this Agreement or in any way otherwise connected to these Events, in any court other than the Circuit Court of Mecklenburg County, North Carolina.

7. I have read this entire Agreement, I fully understand it, and I agree to be bound by it.
